These terms and conditions regulate the business relationship between you and us.
No person under the age of 18 years may purchase Goods.

In this agreement:
“You” means visitor to our website, customer, buyer of artworks.
“Carrier” means any person or business contracted to carry Goods from us to you or you to us, whether all or part of the distance.
“Website” means the website and all content at www.1forart.com
“Commissions” is Artwork supplied according to the Buyer’s requirements.
“Goods” refers to anything we are selling on our website or which a Buyer agrees to buy from the Artist using the Website, including Commissions and Made to Order, as described in the individual listing on the Website.
“Artwork” means the pieces of art which a Buyer agrees to buy from the Artist using the Website, including Commissions and Made to Order, as described in the individual listing on the Website.
“Content” means information in any form published on Our Web Site by us or any third party with our consent.
2. The contract between us and you the purchaser
Goods advertised may sometimes be unavailable.
Your order will be accepted by confirmation email. The email will also confirm details of your order, and a dispatch date will follow. This is when our contract with you is made. Prices may increase from those posted on our site.
Terms may change. The terms that apply to you are those here on our site on the day you place your order.
All descriptions of the goods are given by the artist, and we cannot confirm their accuracy. Therefore any such description does not form part of this agreement.
If any of the goods you order are unavailable you will be offered alternatives prior to us dispatching your order. In this event you can:
Accept the alternative.
Cancel the order.
Tell us to just omit the item which is out of stock.
If you are owed money by us for this or any other reason, your debit or credit card will be credited as soon as practicable, but no later than 30 days from the order date.
Your contract is with us and the artist and you may communicate with the artists in regard to queries about a product via “Ask a Question”. You may not communicate under any circumstances with our artists in regard to sales, commissions or any other transactions taking place off the 1 For Art Website.
3. Price and Payment
You must pay us the full price of your order before we will send any part of it. Banking charges by the receiving bank on payments to us will be borne by us. All other charges relating to payment in a currency other than pounds Sterling will be borne by you.
You will be responsible for any charges relating to a payment made in a currency other than pounds sterling.
Any details we give regarding exchange rates are only approximate and may vary.
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.
The Price includes standard delivery within Mainland UK. The Artist will provide carrier details in your dispatch email.
Additional charges may be made for anything other than standard delivery and for International Deliveries (see clause 6 following), according to the address, size and weight of the Artwork. This will be displayed under “shipping” on the checkout page, if it is not displayed you can contact the Artist directly using the “Ask a Question” form available on the Website or email us at helpdesk@1forart for these charges once you have decided which Artwork you would like to purchase.
4. Information you give us
You agree that you have provided and will continue to provide, accurate and up to date information about yourself to enable us to deliver your goods.
The carrier will deliver to the address given in your order. You must ensure that someone is present to accept delivery.
Artists may offer a range of delivery options (different shipping methods and services) so please ensure that you, the Buyer, select the option you require. However, sometimes these options may be limited because of the type of Artwork or the country you want the Artwork to be shipped to. If you have any queries about shipping please contact the Artist directly using the “contact the artist” form available on the Website.
The goods may be dispatched individually if not all the goods are available at the same time.
Other than for Commissions, unless the applicable listing or Order Confirmation says otherwise, Artists aim to dispatch Artwork to you within 5 working days of the date of accepting your order. If there is going to be a delay the Artist will let you know by email so you can cancel your order or choose another piece of Artwork.
If the Artist is unable to deliver within 30 days of the date of your order then they will, at their discretion, either provide you with a revised delivery date or cancel your order and refund payment made by you.
6. International Sales
Artists on the 1 for Art website are under no obligation to deliver to any country other than the UK.
Delivery of Artwork to an international address is at your own expense. Delivery charges are available on the checkout page.
Prices for delivery may already be quoted online but enquiries for delivery quotes can be made to us or to the artist via “Ask a Question”.
You are solely responsible for complying with any import laws and requirements which apply to the country where the delivery address is located.
The price is displayed in British pounds (GBP) and you will be paying using GBP. If the Website displays a currency converter then this is only a guide/estimate, your payment method provider may make a charge for paying in GBP and they will calculate the rate of currency exchange.
7. Returns and refunds
You are buying goods by mail order, and you therefore may have a right of cancellation. If you do, the following terms apply.
If you would like to return your order, please confirm this in writing by contacting the Artist directly using the “Ask a Question” form available on the Website or emailing us at email@example.com within 14 days following the date you received your order. We will then help you with information about the Returns Method.
If you wish to return your order, you must inform us within 14 days of the receipt of your goods.
You may not cancel or return orders for specially commissioned goods.
The Artwork should be returned unused and in perfect condition with the original packaging, within 14 days of the date you advise us of your cancellation. This is at your expense to the Artist using the postal address provided on the invoice unless the Artist has specifically provided you with an alternative address for the return. We always advise that you return Artwork using a service which provides you with insurance and proof of sending.
The goods are returned at your risk and cost.
When the artist receives the goods we will credit your debit or credit card with the full purchase price.
If the goods are not returned in good condition, you are liable to us for the cost.
We are not obligated to collect goods from you, but if we do, you must pay the costs.
Ordered commissions cannot be returned.
If you have cancelled an order after the order has shipped you must return the order within 5 days of delivery. The parcel must be unopened and undamaged. The goods are returned at your risk and cost.
Unless your item is faulty or we have agreed otherwise with you prior to you returning the Artwork, then you will be responsible for the costs in returning the item to the Artist.
After our artist has received the Goods, we will credit your credit or debit card with the full purchase price of the goods returned no later than 30 days from the date of receipt
If returned Goods do not arrive with the Artist within 14 days of dispatch you are liable to us for the cost. If returned items are destroyed or lost in shipping you must reclaim the cost from the carrier.
8. Faults or Damage to Orders
Where there is a problem with your order, such as the wrong Artwork arrives or Artwork is faulty, then we ask that you contact the Artist directly using the “Ask a Question” form available on the Website or email us at firstname.lastname@example.org within 14 days after the day you received the Artwork.
Consumers may have a right to reject some faulty Artwork but this right is limited to 30 days from the date you purchased the Goods.
If Artwork is damaged you should send photos of the damaged Artwork and packaging and retain the artwork and packaging for 30 days as the courier or artist may wish to inspect it. On behalf of the Artist we may make arrangements for a carrier to collect the Artwork from the address the Artwork was delivered to. We will then either repair the Artwork, replace the Artwork or provide a refund.
Refunds are made no later than 30 days of the date the Artwork is received by the Artist using the same payment method that you used to pay us. Please bear in mind that some payment methods mean that a refund may take up to 7 days to reach your account.
We may make changes to our website, the contents of the site, or the goods, at any time without prior notice.
Content may include technical inaccuracies or typographical errors
We reserve the right to refuse any order for whatsoever reason.
We give no warranty as to;
The adequacy of the goods for your purpose.
The truth of any information on our website.
Any implied warranty or fitness of goods for a particular purpose.
Our liability in any claim against us is limited to the value of the goods purchased.
Our Web Site contains links to other Internet web sites. We have neither power nor control over any such web site. You acknowledge and agree that we shall not be liable in any way for the Content of any such linked web site, nor for any loss or damage arising from your use of any such web site.
10. Contractual Limitations
When goods are provided without a charge, they are not to be associated with any service for which a charge is made. There is, therefore, no obligation on us in respect of such goods.
11. Rights of third parties
Nothing in this agreement or on our web site shall confer on any third party any benefit under the provision of the Contracts (Rights of Third Parties) Act 1999.
You agree to indemnify us against any claim, including lawyers’ fees, made by a third party, arising in any way from your use of our web site, or any infringement by you, or by any other person using your computer, of any intellectual property or other right of any person.
If any of these terms is held by jurisdiction to be void, invalid or unenforceable, then it would be changed to the minimum extent necessary to bring it within the laws of that jurisdiction and will not affect any other of these terms.
15. Dispute Resolution
In the event of any dispute arising from or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.
16. Governing Law and Jurisdiction
These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.
