Artist Terms and Conditions

These terms and conditions form a legally binding agreement between you and 1for Art, the supplier of the Service. Your statutory rights are not affected

You are: a user of our services.

Definitions

“Us/Our/We” means 1 for Art.
“You/Yours” etc. means you, a user of our services.
“Site/Sites” means web site 1for Art.
“Artwork/Artworks” means artwork/craftwork owned and controlled by You for the purposes of selling through the Site.
“Service” means the process of displaying/marketing/selling your Artwork through the Site.

Acceptance of Artist

We reserve the right to accept or decline Your application to market Artworks through Us. Your application includes
Your acceptance of these terms and conditions.
You agree to have Your Artworks and descriptive information displayed on the Site.
You will inform Us of any changes in the information stored by Us including name, address and contact details, pricing of Artworks, and the Sold status of Artworks.
You warrant that all information supplied to Us is accurate and up to date.

Acceptance of Artworks

We reserve the right to accept or decline Your application to market any Artwork through Us for any reason.
If a sale is made you are entering into a legally binding contract with Us to complete the sale and despatch the Artwork in the agreed time.

Non-exclusivity

You may market Your Artwork through other channels simultaneously with marketing through Us.
You do not offer Your Artwork at a price lower than the price which You are offering it through Us.
We will be running a Price Match system for our customers.
If the customer finds the work cheaper on another site, after purchase but within the fourteen day ‘cool off period’, they will be refunded the difference.
If the Artwork is sold through another channel You will immediately remove it from sale on the Site.

Copyright

You warrant the Work is Yours to sell and that all work sold through Us is free of any copyright restrictions or intellectual property disputes.
The copyright in the Artwork will remain with You even after ownership of the Artwork is transferred to the Customer.
You grant us a perpetual and irrevocable licence to use photographs of your Artwork on the Website and in any marketing materials, including on any websites, social media, in any advertising campaigns, online or offline, at any time.

Illustrative Images

You must supply at least two (three if framed) high-quality digital Images of each Artwork if You wish to sell through Us: a Gallery Image and a Close-Up Image. The Images must be in JPEG format. The Gallery Image will show the entire artwork including frame (if framed) with no background. (If artwork is sold framed you must supply an unframed image too) Minimum required resolution is 1200px on the shortest side. The Close-Up Image will show a particular detail of Your Artwork. The width of the Close-Up Image will be at least 1200 pixels.

Pricing and Artwork particulars

You will offer the normal price which the Artwork should be sold for. This price must be inclusive of UK delivery and insurance costs, VAT, (if applicable) and Our commission.

Our commission rate will be 25% for work marketed and sold online.

We will, from time to time, agree to discount work and/or use discount codes. All artists are required to agree to accept such discounts on the selling price.

The discount codes generally offer collectors between 10% – 20% off artwork prices and do not exceed these amounts. For works sold to the trade – we give tiered discounts of 10% – 20% off artwork prices.

(The artists’ income is still greater than sites taking 35% commision and discounting by 15%)

Once accepted You agree to sell the Artwork at the agreed price.

Artwork descriptions are required for SEO and search engine recognition. We reserve the right to add to or amend the description as deem necessary for the artwork to be found on Google, etc.

Delivery, packaging and insurance

You are responsible and liable for costs of all materials, packaging, delivery and insurance costs. These costs cannot be reclaimed from Us under any circumstances and should be taken into account when pricing Your Artworks.
You will ensure that Artworks are packaged, labelled and adequately insured (link to packaging guides) for safe delivery to the Customer.
If for any reason You have grossly overcharged for shipping you must send a refund to the customer before requesting a payment from Us.
You will package and arrange delivery of Artworks to the Customer within a maximum of five working days of receiving the order.
It is a requirement that you ship all orders with tracking details. If an issue arises with an order sent without tracking details, We reserve the right to refund the customer in full on your behalf.

Should You become aware of any reason why an Artwork that has been ordered from You may not be received by the Customer within 10 days, You will notify Us immediately. We will attempt to contact the customer and in some cases may offer a refund to the Customer resulting in the cancellation of the order from You.
This will not apply to commissioned items or items where the customer has requested a postal delivery instead of courier. 

Returns and damaged goods

In the event of the Artwork arriving damaged with the Customer, You will be liable for the costs of retrieving the Artwork.
You will claim any costs in retrieving the Artwork through the insurance cover provided by Your chosen courier. We will not accept claims for reimbursement in the event of damage to Artworks under any circumstances.
You accept that if You have not taken adequate insurance, You will be liable for the costs of retrieving the Artwork.
You accept that the Customer may return the Artwork(s) within 14 days of receipt, and this will constitute cancellation of the order.
The customer in this instance is responsible for the cost of return.
If Artwork needs to be returned, we will release Your details to the Customer.

Payment for Artworks

Should Your Artwork(s) be sold We will raise a purchase invoice for the Price. The Invoice will be paid by Us no sooner than 14 days after We have confirmed delivery of the Artwork(s) to the Customer.
You may request payment via the Artist dashboard on day 15.
Payment will be made by PayPal.

Ownership of Customer relationship

You agree that the business relationship between the Customer and Us is entirely owned by Us. You will not sell directly to the Customer or allow a direct relationship to develop between You and the Customer (now or in the future) that could be detrimental to Us.
Transactions taking place contrary to these terms may lead to You being banned from the site and possible ensuing legal action.

Disclaimer

We reserve the right to change artist terms and conditions, as necessary to support our business objectives, by giving a minimum of 28 days notice in an artists’ newsletter.
Using the service constitutes an agreement to these rules.
